Accessing your Health Information held at Sydney Local Health District

Patients and clients have a legally enforceable right to be given access to information held by a hospital either by giving a person a reasonable opportunity to inspect the document, or by giving the person a copy of the document. Health records are subject to limited exceptions and can be amended to correct inaccuracies.

Sydney Local Health District relies on access provisions in privacy law for patient access to personal health information. The relevant Act for accessing health information is the Health Records Information and Privacy Act 2002 (HRIP Act).

The HRIP Act is used rather than relying upon the Government Information (Public Access) Act 2009 (GIPA). That is, you (or your authorised representative) do not need to make an application under the Government Information (Public Access) Act 2009 (GIPA Act) for access to your personal health information/records.

Sydney Local Health District has procedures for access to health records/information under the HRIP Act, which include:

  • Applying for access in writing and to provide appropriate identification. If you request copies of your own personal health information (or a record on behalf of another person), you will be charged a fee.
  • You are also entitled to view your health record, and this can be organised by contacting the relevant facility. A health information manager must be present for this viewing. *Bookings are essential.
  • Generally, the wait time to obtain your health record is approximately 3- 4 weeks to obtain your record under the Health Records and Privacy Act. While we strive to complete your application as soon as practicable under the HRIP Act, sometimes unavoidable situations may cause a delay. If it is an urgent request, please contact the relevant facility to discuss expediting your request.

In some cases, access to your personal health information may be refused. That is if parts of your record contain information which (by law) cannot be given to you, such as information about another person; or where giving you access would put you or another person at risk of harm.

To apply to view or obtain copies of your personal health information, the Sydney Local Health District HRIPA Application to Access Personal Health Information should be completed and forwarded to the relevant Sydney Local Health District facility you attended.

In some circumstances you may need to make a formal GIPA Access Application for your Personal Health Information; however you will be advised if this is the case.

If you specifically wish to access your records under one of these Acts, the requirements of these Acts apply. 

Amending Personal Health Information

If you think your personal or health information held by Sydney Local Health District is incorrect, you can ask Sydney Local Health District to correct it. If you believe the health information we hold about you is incorrect, please let your health care provider or the relevant facility Medical Records Department know. Corrective action will be taken and you will be informed of the outcome. This action may include correction of the error or addition of a notation to your health record.

To help Sydney Local Health District in maintaining accurate health records, we would appreciate if you could advise your health care provider, relevant administrative staff or the relevant facility Medical Records Department of any changes that are required on your records such as: a change of name, address, contact details, or GP's details.

Please note that it is preferable to put your request for an amendment in writing to the relevant Sydney Local Health District facility you attended.
